Terms of service
Overview
This website is operated by Pacmin, Inc ("we," "us," "our"). By placing an order or using this site, you agree to these Terms and Conditions.
These terms apply to purchases made through pacminmodelshop.com. They do not alter or replace any separate written agreement between Pacmin Studios and a corporate or commercial client.
You must be at least 18 years old to place an order.
Product Categories
We sell three categories of products, and different terms apply to each. The category that applies to your order is identified on the product page at the time of purchase.
Stocked Items are finished models held in inventory. They ship within 3 to 7 business days and are covered by our standard Return Policy.
Limited Edition Releases are produced to order following a defined order window. The order window dates, minimum order requirement, estimated production time, and cancellation terms for each release are stated on that release's product page.
Commissioned and Large-Scale Custom Work is individually fabricated to a client's specification under a separate written agreement.
Where a product page states terms specific to that product, those terms govern.
Orders and Acceptance
Placing an order is an offer to purchase. A contract forms when we accept your order, which occurs when we confirm it in writing or ship it, whichever comes first.
We may decline or cancel an order, including after payment, where the product is unavailable, where a pricing or description error has occurred, where we cannot verify payment or shipping details, or where fulfilment would breach applicable law. If we cancel, we refund you in full.
**Pricing and description errors.** We take care to publish accurate prices and specifications, but errors occur. Where a product is listed at an incorrect price or with a materially incorrect description, we may cancel the order and refund you in full, even if the order was already confirmed. We will contact you before doing so.
Right to Refuse Service
We may decline or discontinue service to any customer, and may decline, limit, or cancel any order, at our discretion and for any lawful business reason. Reasons include but are not limited to prior non-payment or payment disputes, abusive or threatening conduct toward our staff, breach of these terms, suspected fraud, unauthorized resale, or a prior transaction we were unable to complete satisfactorily. We do not refuse service on any basis prohibited by applicable law.
Where we decline an order that has already been paid, we refund it in full.
Estimated Production and Delivery Timelines
Production and delivery timelines published at the time of purchase are good-faith estimates based on our production schedule. They are not guaranteed delivery dates.
If we determine we cannot ship within the estimated window, we will notify you by email with a revised date. If the revised date is thirty days or less beyond the original estimate, you may cancel for a full refund; if we do not hear from you before we ship, we will proceed on the revised schedule. If the delay exceeds thirty days, or if we cannot give a firm revised date, we will proceed only with your express confirmation. Without that confirmation we will cancel your order and refund you in full without requiring you to ask.
Provisional Specifications
Limited Edition models are engineered ahead of production. Specifications published during an order window are provisional and may be refined in production to improve accuracy or manufacturability.
Minor refinements may be made without notice and do not create a right of cancellation, return, or refund. These include livery, marking, and registration detail; paint, finish, and colour matching; base and mounting hardware; and correction of the scale designation where finished dimensions are substantially unchanged.
Material changes will be communicated by email before production begins, and you will have seven days from that email to cancel for a full refund. A material change means a change of more than 10% in finished length or wingspan, a change in aircraft type or operator livery, an increase in price, or an increase in the announced edition size.
Where you have separately approved a personalization preview, that approval is final as to the personalized element.
Cancellations
Stocked Items may be cancelled any time before they ship.
Limited Edition Releases may be cancelled any time before the order window closes. After the window closes and production is allocated, orders cannot be cancelled, because every unit is committed to production at that point.
This does not affect the cancellation rights described under Estimated Production and Delivery Timelines and Provisional Specifications above, or your rights where a model arrives damaged, defective, or incorrect.
Payment Disputes
If something is wrong with your order, please contact us at themodelshop@pacmin.com before initiating a payment dispute. We respond within two business days and can usually resolve an issue faster than a formal dispute process allows.
Nothing in these terms limits your rights under your card issuer's terms or applicable law.
Warranty and Returns
Purchases are covered by our One-Year Limited Warranty and, where applicable, our Return Policy.
Except as expressly provided in those policies, and except for warranties that cannot be excluded or limited under applicable law, products are provided without further warranties.
Intellectual Property
All content on this site — including images, text, design, and the Airfoil™ base design — is the property of Pacmin, Inc. and may not be reproduced without permission.
Airline liveries, logos, registrations, and other third-party marks reproduced on our models are the property of their respective owners and are used under license. Purchasing a model conveys no rights in those marks.
Limitation of Liability
Except in cases of personal injury, gross negligence, or wilful misconduct, our total liability arising from any order will not exceed the amount you paid for that order.
We are not liable for delays or failures to perform caused by events beyond our reasonable control, including supplier failure, carrier disruption, natural disaster, labour action, or government action.
Changes to These Terms
We may update these terms. Each order is governed by the version of these terms in effect at the time the order was placed. Changes apply only to orders placed after the change.
Governing Law and Venue
These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Orange County, California. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer resident outside the United States, nothing in these terms removes any protection you have under the mandatory consumer law of your country of residence.
General
If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.
Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these terms without our written consent. These terms, together with the policies linked from them and any terms stated on the product page at the time of purchase, form the entire agreement between us.
