Overview & Scope

This website is operated by The Model Shop by Pacmin® Studios. Throughout the site, the terms “we”, “us” and “our” refer to The Model Shop by Pacmin® Studios. By visiting our site or purchasing a product from us, you agree to be bound by the following terms and conditions, including those additional policies referenced herein or available by hyperlink.

These Terms of Service apply to all users of the site, including without limitation browsers, vendors, customers, and contributors of content. They do not alter in any way the terms or conditions of any other separate corporate agreements you may have with Pacmin, Inc. for other custom products or services. We reserve the right to update, change, or replace any part of these Terms by posting modifications to our website. Your continued use of the Site following the posting of changes constitutes acceptance of those modifications.

Right to Refuse Service & Account Termination

The Model Shop/Pacmin® Studios reserves the absolute right to refuse service, decline orders, or terminate business relationships with any individual or entity at any time, for any reason, at our sole discretion.

If an order is rejected or canceled by The Model Shop prior to shipment due to a refusal of service (including, but not limited to, customer hostility, unreasonable demands, or communication breakdowns that impede our standard production workflows), a full refund of any processed payments will be issued to the original payment method. The issuance of a refund constitutes a complete and final resolution of the transaction, and The Model Shop shall have no further liability, production obligations, or delivery requirements to the Buyer.

1. Custom Production, Made-to-Order, & Fluid Timelines

Because each custom model is an individually commissioned piece fabricated from scratch, all engineering, production, and assembly timelines provided at the time of purchase are strictly good-faith estimates.

By placing a custom or made-to-order order, the Buyer explicitly acknowledges that custom manufacturing timelines are fluid and subject to change based on workshop volume, material availability, specialized tooling requirements, and stringent final quality control standards. An extension of an estimated production window does not constitute a breach of contract, a delay in performance, or grounds for an order cancellation. The Model Shop reserves the absolute right to adjust estimated delivery dates to ensure the structural, engineering, and aesthetic integrity of the finished exhibit.

2. Limited Edition & Serialized Releases

For products designated as Limited Editions, Special Runs, or Serialized Collectibles, the following additional terms apply:

  • Allocation & Serial Numbers: Specific serial numbers or edition numbers (e.g., "01 of 50") cannot be requested, guaranteed, or reserved unless explicitly stated in writing at the time of purchase.

  • Production Caps: The Model Shop reserves the right to set maximum order quantities per customer or household to ensure fair distribution of limited inventory.

  • Unforeseen Production Limits: In the rare event that a limited edition run cannot be completed due to manufacturing defects, catastrophic tooling/mold failure, or material exhaustion, The Model Shop reserves the right to cancel unfulfilled orders and issue a full refund. The merchant's liability in such cases is strictly limited to a refund of the purchase price.

3. Shipping, Delivery, and Import Duties

All orders are carefully inspected and securely packed before leaving our warehouse. Shipping methods, international shipping options, and handling fees are governed by our Shipping & Handling Policy. The Model Shop is not liable for carrier delays resulting from holidays, severe weather, global logistics disruptions, or customs clearance processes. For international shipments, buyers assume full financial responsibility for all local customs clearance, import duties, and local taxes.

4. Returns, Refunds, and Order Cancellations

  • Standard Storefront Items: Eligible returns and cancellations for non-custom, off-the-shelf items are governed exclusively by our standard Return Policy.

  • Custom / Made-to-Order / Limited Edition Items: Because these exhibits involve immediate resource allocation, custom engineering, and individualized fabrication, all sales are final.

    • No Mid-Production Cancellations: Once an order for a custom, made-to-order, or limited edition item is placed and payment is processed, the order cannot be canceled, revoked, or amended at any point during the production cycle. The Buyer assumes full financial responsibility for the completion of the commissioned piece.

    • No Refunds or Exchanges: These items are strictly non-refundable and cannot be returned or exchanged under any circumstances once production has commenced. However, every custom exhibit and limited edition model remains fully protected by our Product Warranty.

5. Chargebacks and Formal Disputes

The Buyer agrees to exhaust all direct customer service avenues with The Model Shop before initiating a formal payment dispute or chargeback with their financial institution or payment processor (e.g., PayPal, credit card issuer).

In the event that a Buyer prematurely files a "Product Not Received" or "Delayed Performance" dispute while production is still actively underway within the fluid timeline parameters outlined in Section 1, The Model Shop reserves the right to immediately pause all further engineering, manufacturing, and shipping logistics on the asset until the financial institution formally resolves the dispute file.

6. Prohibited Uses & Intellectual Property Rights

You are strictly prohibited from using the site or its content for any unlawful purpose, to infringe upon or violate our intellectual property rights (including reproducing, duplicating, copying, or reselling any portion of our designs, photography, or services without express written permission), or to harass, abuse, insult, or intimidate our staff. We reserve the right to terminate your use of the Service or cancel pending orders for violating these terms.

7. Limitation of Liability & Indemnification

The service and all products delivered to you are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, except as explicitly detailed in our Product Warranty.

In no case shall The Model Shop, our directors, officers, employees, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind—including lost profits or replacement costs—arising from your use of the service or any products procured through the storefront. You agree to indemnify and hold harmless The Model Shop and our parent organization from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to your breach of these Terms.

8. Governing Law & Contact Info

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of California and the United States.
